Terms of ServiceUpdated 8 Februrary 2008.
You:
- Regardless of what type of service you purchase from us, you will not use it to engage in any of the activities on the following list. Doing so will result in immediate suspension and lickety-split shutdown of your account.
- Porn
- Gambling
- Provide pirated or otherwise unlicensed software (this includes linking to warez)
- Upload or store copyrighted music or other digital data that you do not have permission to distribute (this includes linking to such material).
- Provide or facilitate malicious applications
- Have anything to do with spamming. Anything at all. We hate spammers.
- Do anything at all related to IRC. No servers, no clients, nothing.
- Host Proxy servers
- Host applications that provide, as their primary service, file transfers
- Will not provide any kind of web hosting to other parties unless you have purchased a Reseller Account.
- Acknowledge that Hosting Puppy reserves the right to add whatever else we feel like to this list as we discover new ways in which people are being bad
- Acknowledge that the space you rent from Hosting Puppy is for web hosting only. You must provide a domain name that is pointed to our nameservers and you cannot use the web space for backup space or any data that is not designed to be served up to visitors.
- Understand that you are entering into agreement with Rama Media Group, a limited liability corporation incorporated in Delaware, USA.
- Will not place anything on our servers that you either do not own or do not have the rights to place on our servers.
- Will not run any processes or scripts that degrade the service or performance of other accounts on your server.
- Understand that we will not transfer any accounts from your previous host to our servers if you are a Buck A Gig customer. The WHM transfer system is too unreliable, the Internet is too fragmented, and your old host is too uncooperative for us to justify the cost of doing this for you. We will transfer accounts for Hosting Puppy Pro and Gold members, however.
- Acknowledge that this ToS is updated from time to time and agree to comply with the changes as they occur.
Cancellations and Suspensions:
- Accounts must be kept up to date. Accounts that are overdue by 5 days without prior arrangement with us will be suspended. Accounts that are overdue by 20 days without prior arrangement with us will be terminated. We're nice people - talk to us if you anticipate a problem.
- All of your services with Hosting Puppy are considered one package and cancellations and suspensions will be dealt out on all of your services as a whole.
Refunds:
- Hosting Puppy offers refunds in our 14-day money-back guarantee in order to ensure that Hosting Puppy is suitable for you.
- Hosting Puppy will only offer refunds in two instances:
- You request a refund and cancellation of your account within the 14-day money-back guarantee period, or
- We break our SLA (either the 99.9% uptime in a 30 day period or the 60-minute support promise) in which case we will refund you the princely sum of $1 for each violation. This refund will be applied to your account rather than given in cash. 99.9% uptime refers to HTTP (web) only and is calculated on a 30-day rotating basis (meaning it is not possible to have more than one uptime violation in any given month). We use Pingdom to monitor our uptime and those reports are the only method used to determine uptime.
Resellers:
- Only the main reseller account has access to Hosting Puppy's FAST 60-minute support guarantee. Hosting Puppy support is only available to the reseller and not the reseller's clients.
- You cannot use the Hosting Puppy reseller package to operate a free web host. You can use the service to provide web space as a value added product for your already existing business and clients. Examples of this are web designers, domain sellers, and other businesses that wish to provide web space in addition to their core product for their already paying customers. If you are unsure if you qualify, please ask before ordering.
We:
- Will provide power and network connectivity
- We guarantee 99.9% uptime with the SLA remedy in the Refunds section of this Tos.
- Will provide support up to what is included in your particular plan
- Will not generally support web site issues such as troubleshooting file placement or PHP scripts. You can ask and we may have time to help, but website troubleshooting that involves problems not related to our server or server configuration is outside of our business model
- Are available for paid support to assist in trouble-shooting your custom, non-supported applications
- Will keep you informed of any data center or server activities that may affect your experience with us via the Hosting Puppy Forums
- Will keep all of your personal information completely confidential
- Will man the 1-866-968-4666 pre-sales number from 8am to 8pm every day PST
- Will man the support@hostingpuppy.com email address for support issues and respond within 60-minutes (only between 8am and 8pm for Buck a Gig customers, 24/7 for Pro and Gold customers)
- Will not be held responsible for any financial or other losses due to your use of Hosting Puppy services.
